How we do Licensing

Having an official license for the designs you are using, is an important part for your business.
You see, what many designers don't tell you - or don't even know - is, that after you pay for their design work, the logo does not actually belong to you legally.

That's right: You pay only for the designer's work, but not for the final product.
And the really bad thing about this? The designer still owns the copyright to 'your' logo.

Worldwide, most legal systems account a logo still to be the copyright of the creator. Which means, the person or company he made it for, doesn't have any rights. No matter how much they paid the designer to make it.

That can result in somebody stealing your logo and you can't do anything about it, because as a matter of fact: It's not actually your logo.
Or worse: If for what ever reason, you designer has it out for you, they could sue you for copyright infringement.
Also, the designer could just sell the logo to other people.

This, by the way, does not only count for design, but for pretty much any creative kind of product, including writing, coding (it counts as writing, too), music, art, performance, ect.

How we structure our license fees

At Moving Robin we care a lot about fair compensation for our designers, fair business standards as well as - or even more so - you getting treated fairly.

Therefore we do our best to secure you from potential logo or CI theft or law suits.

We decided to go with the official calculation system, set up by the AGD, the Alliance of German Designers. This is a standard that German designers try to agree on, to give designers as well as customers fair treatment.

The license fee is always based on the price the client paid the designer to create the creative work. With the help of a couple of factors, we now define the amount of money the client has to pay to get the according copyrights. Generally, this is the formular we are working with:

cost of design work x (kind of usage + usage area + usage extent + timeframe of usage) = license fee

cost of design work x (kind of usage + usage area + usage extent + timeframe of usage) = license fee

Kind of Usage

simple
factor: 0.2

the designer still has rights to sell or use the design

 

extensive
factor: 1.0

the designer gives up all the rights to use or sell the logo without permission

Usage Area

regional
factor: 0.1

if you use the design only in a specific region and not on the internet

 

national / state wide
factor: 0.3

you are allowed to use the design within your country/state. You are allowed to use the logo on the internet, as long as your website has a national/state domain ending (i.e. co.uk, .de, .es.ca.us). Your website or any social media channels using the logo, can also only present your national language.
For small countries, that border to countries with the same language, we tend to make exceptions (like Switzerland, Austria and Germany).

 

continent wide
factor: 1.0

you are allowed to use the design within your continent. You are allowed to use the logo on the internet, as long as your website(s) has a national/state domain ending (i.e. co.uk, .de, .es.ca.us) that's inside the continent or the continent's domain ending (i.e. .eu, .lat, .asia) .

 

worldwide
factor: 2.5

you are allowed to use the design anywhere in the world, including anywhere on the internet.

Usage Extent

extensive
factor: 1.0

You are allowed to use the logo for anything.


Since we provide logo and CI design (which is usually extensively used by a company) we only offer this option.

 

Timeframe of Usage

1 year
factor: 0.1

The license contract has to be prolonged one year later, or it expires.

 

5 years
factor: 0.3

The license contract has to be prolonged five years later, or it expires.

 

10 years
factor: 0.5

The license contract has to be prolonged ten years later, or it expires.

 

unlimited
factor: 1.5

The license contract needs no prolonging. The deign is yours until the end of time.

For example, if you have us design a logo for you to have the full rights and use it worldwide for one year, the formular would look like this:

3999€ x (1.0 + 2.5 + 1.0 + 0.1) = 18,395.40€

 

If this seems complicated to you, fear not:
Our onboarding system will calculate the exact number for you. If we notice, that you live in a small country or that anything else might be unfair, we will come right back at you and make you a fair offer.

Wrapping up:

Proper licensing might seem expensive, depending on your circumstances. However, it comes in really cheap in comparison to a law suit in case somebody decides to do something with your logo that you did not intend it for. It's better to be on the safe side.

Also, the license fee can be used in your next tax statement, which can catapult you to a completely new tax level ;)
